$10 Million Actos Lawsuit Transferred to MDL

shutterstock_564349648Wanda Heavy’s lawsuit against Takeda Pharmaceuticals has been transferred to MDL 2299, in Louisiana (Lafayette).

Heavy was prescribed Actos treat her Type 2 diabetes in 2005, and used it as told until 2010 when she was diagnosed with bladder cancer.

The original case was filed in New York on July 12, 2012, and was recently transferred to the MDL in Louisiana, the Honorable Judge Rebecca Doherty presiding. Heavy is suing Takeda Pharmaceuticals for negligence, consumer fraud, failure to warn, and defective design. She seeks $10 million for not only financial recompense but because she suffered physical injury and emotional distress.

Several studies in 2011, as well as this year, have linked Actos to an increased risk of bladder cancer, especially when used for more than 2 years. In June 2011, because of these studies, both France and Germany pulled the drug from their markets, and the FDA issued the strongest warning label for the drug in the US.

Judge Doherty recently released a schedule for bellwether trials, and extended the deadline to file in MDL 2299 in order to gather as much evidence as possible.
