Houston Mother Issues Wrongful Death Lawsuit Against Pharmacy

After Daughter Died of Morphine Overdose, Mother Sues Pharmacy for Liability in Wrongful Death

wrongful deathA mother from Houston, Texas has issued a wrongful death lawsuit against a local pharmacy that gave her 6-year-old daughter the wrong dose of a strong prescription pain medication.

Simone Allen’s daughter, Jadalyn Williams, had sickle cell anemia, and as part of her treatment program through the Texas Children’s Hospital, she was prescribed a low dose of morphine to help treat her chronic pain and occasional pain flare ups.

On March 28, 2012, Williams was prescribed her normal 15 mg dose of morphine, and the family filled the prescription at Cullen Care Pharmacy, where they had been customers for 10 years. However, on April 2, 2012, when Allen gave her daughter the normal dose as instructed on the bottle, the little girl was found unresponsive the next day.

Jadalyn’s reported cause of death was morphine toxicity, and was ruled an accident. However, tests showed that the amount the girl ingested was not 15 mg, but 150 mg, far too much for someone of her size and age.

“They gave me the medicine to help her with her pain and it ended up killing her,” Allen said.

The distraught mother as now issued a wrongful death lawsuit against the Cullen Pharmacy, seeking damages up to $1 million for emotional pain and suffering. She and her attorneys also want answers from the pharmacy or its insurer.

“I do want an apology,” Allen said. “I lost my child. Why wouldn’t you call me to say Simone I’m sorry? I trusted them with my kid’s medicine and they made a mistake and I don’t want them to do it to anyone else.”

“And I would like to know whether they have been disciplined, trained or whether it’s just business as usual for them,” attorney Muhammad Aziz said of the unidentified person who filled the prescription.

The family’s lawyers have been attempting to settle the wrongful death lawsuit with the pharmacy’s insurers, but reportedly “negotiations broke down.”
