Litigation Judge Issues TVM Protective Order

After a status conference on July 26th, Litigation Judge Joseph R. Goodwin issues a TVM protective order to protect the companies involved in several of his MDL suits.

Judge Goodwin is currently overseeing MDL 2327 (In re: Ethicon, Inc., Pelvic Repair System Products Liability Litigation), MDL 2325 (In re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation), MDL 2326 (In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation), and MDL 2187 (In re: C.R. The Stipulative Protection Order was issued to shield the defendant companies from their competitors, without infringing on plaintiffs’ right to consult with experts. Information used in litigations could potentially be leaked to the defendants’ competitors, causing significant harm to the defendant. Judge Goodwin’s order gives instructions regarding how the counsel can determine which documents are confidential, which information is privileged, and how counsel can use and access information during the pelvic mesh litigation.

Transvaginal mesh, or TVM, has a long history of failure after implantation. The first approved TVM device, the ProteGen, was recalled in 1999 because of defects. However, a loophole in FDA law called 510(k) has allowed other mesh devices to be approved on a fast-track due to their similarity to the original device. Many women have suffered from the faulty implants because of this law.
