In early May, four plaintiffs filed personal injury lawsuits against the chain restaurant, Golden Corral, in Casper, Wyoming.

The personal injury cases were related to an outbreak of norovirus that originated when the four plaintiffs ate at the Golden Corral in Casper last year. The cases were originally dismissed in April from federal court due to jurisdictional issues, but the plaintiffs have moved forward to file civil suits against the buffet-style restaurant instead.

Wyoming’s statute on personal injury lawsuits states that plaintiffs have four years to file suits. Jason Ochs, attorney for the four plaintiffs, said that he planned to file a class-action suit at a later date.

According to the Wyoming Department of Health, 300 people developed gastrointestinal illnesses after catching norovirus at Casper’s Golden Corral between November and December of last year.

“The bigger issue is letting the personal injury cases drive the litigation,” he said. “They are the ones that need to be compensated, first and foremost.”

The defendants in the personal injury lawsuit are listed as Golden Corral Corp., and franchise owner DBL Inc. Neither defendant’s attorney would comment on the personal injury suit.
