Rolling Stone Sued?

SC Business Litigation Attorneys

A new bar in Columbia is facing a trademark lawsuit over their name.

The Rolling Stone Bar on Rosewood Drive was hit with a lawsuit from the Rolling Stone magazine claiming “blatant copying” of the logo. The lawsuit orders bar owner, Jimmy Phillips, quit using the name and “make an appropriate monetary offer to address the damages to date,” according to The State Newspaper. The Rolling Stone magazine also owns a restaurant and bar in Los Angeles called the Rolling Stone.

Phillips feels the magazine is a “corporate bully”. He has hired a lawyer and plans to aggressively defend his right to the name. He says he has “no intention of changing the business name” and hopes the public will pressure the magazine to back out of the lawsuit.

Phillips stated that the phrase “rolling stone” has been in existence for centuries and has been used in music for many years. He feels the magazine is trying to own the phrase. According to Wikipedia, “A rolling stone gathers no moss is an old proverb, credited to Publius Syrus (a Syrian writer of maxims in the 1st Century B.C.), who in his “Sententiae” states, People who are always moving, with no roots in one place, avoid responsibilities and cares.”
