Takeda Denies Hiding Risks of Actos and Bladder Cancer

actosTakeda Pharmaceuticals denied that the company hid the high risk of developing bladder cancer from taking Actos during its Nevada trial.

This is the sixth Actos lawsuit that has gone to trial in the US involving Actos injuries.

“There was no hiding of the ball,” Craig Thompson, a lawyer for the Osaka, Japan-based company, said Tuesday in his closing argument in Nevada state court in Las Vegas. “The Actos label accurately reflected what was available at the time.”

The first bellwether case in the Actos multidistrict litigation (MDL) was decided in favor of the plaintiff. Takeda Pharmaceuticals, along with its US distributor Eli Lilly, was ordered to pay $9 million in punitive and compensatory damages. Terrence Allen, the plaintiff in the first bellwether case in the Actos multidistrict litigation, was awarded $1.3 million in compensatory damages out of the $9 billion. More than 2,700 personal injury suits linking Actos use to bladder cancer have been consolidated in the MDL.

“A drug company is not allowed to put profits before patients’ safety,” said Robert Eglet, attorney for Nevada plaintiffs Delores Cipriano and Bertha Triana. “A drug company must tell the truth, the whole truth, and nothing but the truth about the risks of its products.”

Eglet seeks the maximum possible personal injury compensation from Takeda Pharmaceuticals – $1 billion.

“Due to Takeda Pharmaceutical’s conscious decision to keep this information from consumers and their doctors, we now have patients who are left to bear the permanent injury caused by Actos,” Eglet said in a previous statement. “That’s why we will be asking for over a billion-dollar punitive damage verdict.”

Takeda denied the charge from Eglet in closing statements.

The jurors heard closing arguments and will soon convene to decide the outcome of the Actos personal injury trial.

“The central issue in this case is: Did this medication cause this disease in these women at the doses and lengths of time that they used it?” Thompson said.

“I remember taking it over a year,” Cipriano told jurors. She said that Takeda failed to warn her or her doctors of the potential serious side effects from taking Actos. “If they did, I would have really paid attention,” she added.
