Pharmaceutical Company Wins Actos Lawsuit in Nevada
Over the past couple of years a number of Actos lawsuits have been filed. The Japanese pharmaceutical manufacturer behind Actos was recently found not liable in a massive personal injury case in Nevada, in which two plaintiffs alleged that the Type 2 diabetes drug caused bladder cancer.
The lawsuit was heard in Las Vegas, Nevada. On May 22nd, a jury decided that Actos was not responsible for the bladder cancer suffered by the two plaintiffs in the personal injury lawsuit.
“We’re very pleased we prevailed,” Takeda’s general counsel, Kenneth Greisman, said in a phone interview. “We remain confident Actos is an important treatment for patients.”
“It was obviously disappointing — particularly disappointing for the clients, because that is why we do this,” said the attorney for one of the plaintiffs, Robert Eglet.
The two plaintiffs – Bertha Triana and Delores Cipriano – asked for the largest possible sum available in Las Vegas personal injury claims, which is $1 billion.
Both Triana and Cipriano were diagnosed with bladder cancer after the two had been prescribed Actos to treat their Type 2 diabetes for years.
Eglet said that he has two other plaintiffs who allege that Takeda Pharmaceuticals caused their bladder cancer injuries. That Actos trial will move forward in October of this year.
“The question is: Would they have developed the bladder cancer anyway without Actos?” said Adam Levine, a Florida-based doctor and lawyer.
“Justice really hasn’t been served for anybody, because the verdict is still out about whether Actos causes cancer,” Levine said.
“Takeda is confident in the therapeutic benefits of ACTOS and its importance as a treatment for type 2 diabetes and we will continue to defend the company vigorously in these cases,” Senior Vice President and general counsel Kenneth D. Greisman said.
Actos Linked to Serious Personal Injury
The FDA is currently investigating the risks of taking Actos, and says their review will wrap up next year. Based on evidence from new studies, the government agency issued a warning against Actos and said Takeda had to package their drug with the strongest possible warning label. Meanwhile, both France and Germany banned the drug from sale in their countries, and most recently, India temporarily banned
Actos and the generic form pioglitazone, but after confrontations with doctors, rescinded the ban pending further study. The generic form of Actos, pioglitazone, was approved for use by the FDA last August.
