Woman Hits House After Having 15 Drinks

South Carolina DUI Lawyer

A New York woman is behind bars charged with driving under the influence after plowing through a house.

Sophia Anderson, 21, from Brooklyn allegedly drank approximately 15 drinks before getting behind the wheel of a Mercedes and crashing it into, 96 year old, Helen Indiere’s kitchen. The Mercedes belonged to the family of Anderson’s boyfriend, Dan Sajewski. Sajewski took the car without the knowledge of his family members while they vacationed for Memorial Day.

Anderson was charged with driving under the influence after a breathalyzer test revealed a .30 Blood-Alcohol Content  (BAC) level, which is almost four times the legal limit. She is currently being held on $50,000 bail and has entered a not-guilty plea. Sajewski was not charged in the incident.

Anderson’s lawyer, John Loturco, plans to challenge the accuracy of the breathalyzer’s .30 Blood-Alcohol content reading. Loturco says his client only had three beers.

Breathalyzers are often challenged in court. If you are arrested for DUI, your South Carolina DUI Lawyer may challenge the results of your breathalyzer test as well as the results of a field sobriety test.

In South Carolina, a breathalyzer test must:

  • Be videotaped;
  • Be conducted within two hors of your arrest;
  • Be processed on a DataMaster machine that is properly calibrated;
  • Be administered by a certified testing operator;
  • Be conducted on a properly maintained machine.
